BOSCHENDAL EXTERNAL PRIVACY POLICY

Boschendal (PTY) LTD is committed to protecting the Personal Information of data subjects processes in line with the requirements of global data protection laws and regulations. To this end Boschendal created this Policy to demonstrate its commitment to Privacy and Information Protection.

 

This External Privacy Policy , together with our Website Terms (collectively, the “Terms”) form a written contract between you and Boschendal. These apply to all users of any of our Platforms and Services. Our Platforms refers to websites, mobile sites, mobile applications, social media platforms, emails, telephone lines or any other technology or channel you may use to interact with us”. “Services” refer to any products, goods, services or functionality offered, owned or operated by Boschendal via our Platforms.

 

All reference to “we” , “us” and “our” refers to Boschendal (PTY) LTD (“Boschendal”), affiliates, parent companies and any of their respective associated companies and related businesses (e.g. Boschendal Wines).

 

The purpose of this External Privacy Policy is to describe how we collect, use, store and disclose Personal Information that Data Subjects provide to us, what we learn about Data Subjects from their visit to our Platforms or Services, as well as to explain the choices and rights that Data Subjects have regarding the processing of their Personal Information by Boschendal.

 

By using our Platforms and Service you acknowledge that you have read and understood the terms outlined to the terms outlined in this Policy. Therefore, you consent and agree to the processing of your Personal Information in compliance with this Policy.

 

Boschendal takes reasonable steps to protect Personal Information and handles such information in compliance with applicable Data Protection laws. In the context of South Africa, does so in compliance with the Protection of Personal Information Act (“POPIA”) 2014 as the countries Data Protection legislation.

 

Boschendal reserves the right to modify, add or remove certain sections of this External Privacy Policy without notice. We encourage you to visit this Policy on a continuous basis to familiarise yourself with this External Privacy Policy.

While using our Platforms or Services, you may be requested to provide certain Personal Information, which identifies you as an individual (including, but not limited to, your name and contact details). We collect and receive your data in the following manners:

 

  • Information you willingly give us – This includes any information that you provide to us directly, whether in person or through our Platforms, via phone, text messages, social media, fax or any other medium, this may include information you give to us:
  • by filling in forms on our Platforms (like when you register on our Platforms or subscribe to use services on our Platforms) or when you visit our premises (like when you eat or stay with us, or come to our events;
  • when you enter a competition, promotion or complete a survey;
  • by posting comments or content on our Platforms;
  • when you purchase one of our Services;

How we use the information we collect and store (purpose for collection):

 

  • enable you to make use of our Platforms in the manner described on our Platforms,
  • enable us to make relevant recommendations on a personalised basis; which may include tailoring our Services and Platforms to your interests and needs, and ensure they work on your device;
  • send you information, advertising or newsletter about our Services or the Services of other companies in our group;
  • compile and maintain our Platforms and client database;
  • register and/or authenticate users of and/or visitors to our Platforms;
  • identify and take reasonable measures to prevent fraudulent use of or access to our Platforms;

  • to develop and improve our Services, communication methods and the functionality of our Platforms;
  • We may publish feedback (comments or reviews) provided by you via our Platforms or otherwise on our social media accounts or in other promotional material or brochures

Processing includes collecting, receiving, recording, organising, collating, storing, updating, modifying, retrieving, altering, consulting or using, disseminating, distributing or making available and merging, linking, blocking, degrading, erasing, destroying Personal Information. Processing of Personal Information is also performed to comply with applicable laws.

 

How we share the information we collect and store. We may share information with:

 

    • Companies in our group, in other words, our holding company and subsidiaries;
    • affiliated companies;
    • Our local agents, listed below;
    • Business partners. We may share non-personally identifiable information with select business partners. This means that we do not disclose information about identifiable individuals to our business partners, but we may provide them with aggregate information about our users;

    • advertising providers, which help us provide ads that are tailored to users’ interests and understand how users respond to those ads;
    • Audience-measurement companies, which help us measure the overall usage of our Platforms and compare that usage to other online services;
    • Social networking services (like Facebook, Twitter, LinkedIn, Instagram) that enable you to register and log into certain of our services and to share things you find on our Platforms with your social network. This is only applicable if you choose to connect with a social networking service; we may provide other registration and login methods. These third parties may collect or receive information about your use of our Platform, including through the use of cookies, web beacons and other technologies, and this information may be collected over time and combined with information collected on different websites and online services. It’s important to remember that we don’t control the privacy practices of these (or any other) third-party services. So we encourage you to read the privacy policies of these services before connecting to them.
    • These parties may be situated in a different country to you. You agree that your information may be shared with any of the abovementioned parties in another country and you consent to the cross border transfer of your information to another country, whose privacy laws may not be equivalent to the laws in your country of residence.
    • In addition, by using our services, you consent to future communication being conducted over the WhatsApp Messaging platform, which is owned by Meta. This includes but is not limited to notifications, updates, and other relevant information related to our services.

 

Google Analytics:

When you provide consent to be tracked while visiting our Platforms, we may collect information using Google Analytics Advertising Features. These features enable us to enhance our understanding of user behavior and provide personalized advertising and recommendations. The Google Analytics Advertising Features used include:

 

  • Remarketing with Google Analytics
  • Google Display Network Impression Reporting
  • Google Analytics Demographics and Interest Reporting
  • Integrated services that require Google Analytics to collect data for advertising purposes, including the collection of data via advertising cookies and identifiers
  • By enabling Google Analytics Advertising Features, we allow Google Analytics to collect data about your visit using Google advertising cookies and identifiers, in addition to the data collected through our standard analytics implementation.

 

Storage

  • We may keep your Personal Information in either electronic or hard copy form. In both cases, we take reasonable and appropriate steps to ensure that the Personal Information is protected from misuse and loss and from unauthorised access, modification or disclosure.
  • Moreover, we will only keep your Personal Information for as long as is necessary to fulfil the purposes described in this External Privacy Policy, unless you have given us permission to keep it longer or we are otherwise legally permitted to do so.
  • Although no one can guarantee the security of the information collected and received, we do employ a number of safeguards intended to mitigate the risk of unauthorized access or disclosure of your information. We will do our best to protect your personal information and we will use up to date technology that will help us to do this.

 

Your Data Subject Rights:

As a Data Subject of Boschendal you have the right and responsibility to ensure that the Personal Information we hold about you is accurate. In the absence of evidence to the contrary, we will assume that the information you provided to us is accurate. At your request, where the law requires us to do so, you can exercise your Data Subject rights as per the following, subject to verification and validation of your identity:

  • Request access to your Personal Information that Boschendal holds about you as set out in our PAIA manual.
  • Request rectification of your Personal Information that Boschendal holds about you.
  • Request erasure, as permitted by law, of your Personal Information that Boschendal holds about you.
  • Request restriction of processing of your Personal Information.
  • Object to processing of Personal Information as permitted by law.
  • Lodge a complaint as it pertains to the processing activities of your Personal Information.
  • Ask us not to contact you for marketing purposes. You can exercise this right at any time by using any of the various “opt-out” options that we will always provide to you when we communicate with you.
  • Reject our cookies, you can do so by configuring your browser to do so.
  • if you have given your consent for us to use your personal information, you have the right to withdraw your consent at any time (although if you do so, it does not mean that anything we have done with your personal information with your consent up to that point is unlawful);
  • You have various rights over how your personal information is processed and can exercise these rights at any time by sending an email to marketing@boschendal.co.za

International Users:

Boschendal is based in and operates from South Africa, and, regardless of where you use or access our Platforms, products, or services, your information may be transferred to and maintained on servers located in South Africa (or elsewhere in the world). Please note that any information we obtain about you will be stored in accordance with South African privacy laws, regulations and standards, which may not be equivalent to the laws in your country of residence. By using our Platforms you consent to this collection, transfer, storage and processing of information to and in South Africa.

We may update this privacy policy from time to time. Any changes we may make to our privacy policy will be posted on this page and, where appropriate, notified to you in the appropriate manner.
